In many instances the first action in the litigation process of a divorce is for the parent who remains with the children ( after the other parent has left the matrimonial home ) to apply for “Interim maintenance” whilst the divorce is being finalised ( Rule 58 in Regional Courts and Rule 43 in High courts). Currently the High Courts in Gauteng require extensive financial information disclosures to accompany a Rule 43 application, that is the FDF ( Financial Disclosure Form).
Where couples are married in community of property or as per an Antenuptial Agreement with accrual, the accrual calculation may become quite complex especially where businesses, multiple properties and investments etc is concerned. Attorneys are brilliant at what they do, but sometimes the assistance of someone with expert financial knowledge and skill is required to assist with the calculations.
